Recall Update – Next Steps and Dates

October 14, 2023

Many people have been asking questions. Hopefully, this post will answers yours. If not, feel free to email info@ivcbcommunity1st.org with your question(s).

The office of the Nevada Secretary of State is expected to be informed on Monday, October 23rd regarding the sufficiency of verified signatures. If there are sufficient signatures, the person(s) being recalled have 15 business days to challenge the sufficiency of the petition(s) in District Court. If there is a challenge, the timeline will be altered based on the court complaint.

If there are insufficient verified signatures, the determination may be challenged with the Secretary of State. The decision of the Secretary of State is final. The decision of the Secretary of State may be appealed in District Court.

If there are no challenges to the sufficiency of the recall petition(s) or if the District Court determines the recall is to proceed, the process of creating the ballot and the attainment of voting locations will begin. The Registrar of Voters has 20 to 30 business days after determining sufficient verified signatures to “call” for the recall ballot (“election”). The “election” must be held within 30 days of being “called” by the Registrar of Voters. The ballot will contain only the name(s) of the person(s) with the vote being to recall or not to recall. There will be no candidates for potential replacement(s) on the ballot. Should either or both receive more votes to recall than not to recall, the remaining members of the IVGID Board of Trustees will appoint replacement(s). There will NOT by vote or an election for new Trustees, but would be appointment by the remaining IVGID Trustees or the Washoe County Board of Commissioners, should there be a split vote.

IVGID will be charged for the costs of the “election”. To read more about what comprises the costs, costs yet to be determined, click here.

To remove your name from the recall petition list, you may do so through Monday morning, October 23rd. You may email electionsdepartment@washoecounty.gov with your name, physical address and specify your request to remove your name from the petition to recall IVGID Trustee Matthew Dent and/or the petition to recall IVGID Trustee Sara Schmitz.
